Warrant of Fitness Terms and Conditions

These are the terms and conditions on which the Warrant of Fitness will be provided to the Customer by ADT.

TERMS

Warrant of Fitness [“WOF”]

This is an annual maintenance service during which the working operation of the customer’s ADT monitored security system will be confirmed. In addition a replacement security control panel back up battery will be fitted. A certificate detailing all the checks completed will be provided to the customer at the conclusion of the maintenance service visit. This excludes any parts or labour required to repair any defects found, which are outside their installation warranty.

The person or legal entity named as the recipient of this service.


CONDITIONS

The Parties to the Agreement are the Customer and ADT
The Customer and ADT agree that the provision of the WOF is part of the Customer’s responsibilities to maintain their ADT monitored security alarm system. This is not an equipment warranty or guarantee.

The WOF provides for up to a maximum of one (1) hour of on-site time by an ADT technician upon a single scheduled attendance and details the visual condition of the Customer’s security alarm system and the communication devices used for the transmission of signals to the ADT monitoring centre. The service undertaken carries no warranty for parts or labour.

Any repairs required may incur further labour and parts. Prices will be agreed with the Customer before the commencement of the required repairs.

Commencement of the WOF service
The date on which the first Warrant of Fitness payment is made.

Agreement term
There is no minimum term. Fees are paid monthly in advance and are non refundable. The WOF visit will be scheduled with the Customer after payment of 12 consecutive monthly payments.

Fees
The Customer must pay the monthly fee as set out in the confirmation letter by Direct Debit. After 12 consecutive monthly payments, the WOF visit will be scheduled.

How can the Fees change?
(a) The fees are fixed for the first 12 months from the commencement date.
(b) After the first 12 month period the fees may be subject to change. ADT will provide the Customer with one (1) month’s written notice of any change in the Fees.
(c) If any Government or any other party imposes additional taxes or increases existing taxes then the Customer will be responsible for paying those increased costs as part of the Fees from the date they are implemented.

What are ADT’s obligations?
(a) Following the 12th consecutive monthly payment for the WOF, the Customer will be contacted by ADT to arrange a site visit by a qualified technician from ADT.
(b) If ADT, after a 10-day period, is unable to contact the Customer, they will send a letter requesting the Customer to contact ADT to arrange their WOF visit.
(c) ADT will provide a trained security alarm technician to perform a comprehensive inspection service to confirm the working operation of the Customer’s ADT monitored security alarm system.
(d) ADT will provide the WOF within normal business hours only, these being Monday to Friday between 8am and 5pm, excluding statutory holidays and regional anniversary days.
(e) ADT will provide the WOF subject to the Customer maintaining an ADT monitored security alarm at premises within the geographically qualifying areas, as updated by ADT from time to time.

What are the Customer’s obligations?
(a) Pay the Fees for the WOF monthly in advance by way of direct debit from the Customers nominated financial account.
(b) Have their security alarm system monitored by ADT Security.
(c) Contact ADT in the event of changes to your circumstances or address. The WOF automatically transfers premises provided the Customer maintains a monitoring agreement with ADT and the new premises is within a qualifying geographic area.
(d) Provide safe access to the site to ADT or its authorised contractor when requested by the Customer to carry out the WOF service.
(e) Advise ADT when WOF visits are no longer required.

What happens if during the WOF Inspection the Customer’s security alarm equipment is found to be faulty?
The WOF provides for up to one (1) hour of technician time on site at the Customer premises during a single site attendance.

Should faults requiring repair be identified during the WOF inspection then ADT will identify to the Customer the type and nature of the repairs recommended along with ADT’s then current service labour rates and the price of parts required to remedy the identified fault(s). Upon acceptance of the ADT service labour and part prices ADT will agree a scheduled time to complete the repairs. Payment for the repair services will be required within 7 days of the invoice date from ADT. Repairs of this nature are not subject to the terms and conditions of the WOF.

Termination of the WOF
(a) Either party can notify the other of their intention to terminate the WOF service by giving one (1) month’s notice in writing.
(b) In the event that the Customer notifies ADT of their intention to terminate this WOF service the Customer acknowledges that

  • ADT does not offer a credit or a refund for unused Inspections.
  • ADT does not provide the WOF in advance of the Fees being paid.
  • (c) The Customer is deemed to have terminated this WOF service if they

  • change premises to a location which falls outside the geographic coverage areas, as maintained by ADT from time to time or
  • commit an act of insolvency.
  • (d) In the event that ADT notifies the Customer of their intention to terminate this WOF service ADT acknowledges that

    ADT will agree with the Customer to provide either;

  • a credit of the unused amount under this WOF service OR
  • a refund of the unused amount under this WOF service.
  • Limitation of ADT’s liability
    ADT’s maximum aggregate liability arising out of or in connection with the WOF shall be limited to the sum paid in any 12 month period to ADT for WOF services. To the maximum extent permitted by law ADT is not liable for any indirect, special or consequential loss whatsoever arising out of or in connection with the WOF, incurred or suffered by the Customer or any other person.
